Terms of Use

Welcome to GetZelling. These Terms of Use (“Terms”) govern your access to and use of the GetZelling website, its contact forms, listing and buyer resources, property information, and related online features (collectively, the “Site”). The Site is operated by GZ PropTech Inc., a Florida corporation doing business under the registered Florida fictitious name GetZelling (“GetZelling,” “we,” “us,” or “our”).

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Additional agreements may apply if you engage us for real estate brokerage services or use a separate product such as MarktMind.

1. What GetZelling provides

GetZelling provides general information about residential real estate in South Florida and describes planned services for sellers and buyers, including property and market resources and preliminary inquiries. As of the date of these Terms, GZ PropTech Inc. is preparing for its Florida real estate brokerage license and has not launched licensed brokerage services. Brokerage services will be offered only after the company obtains the required active license and satisfies applicable legal requirements. The availability and geographic coverage of future services may vary.

The Site is for general information and initial inquiries. Displaying a property, describing a service, providing a preliminary estimate, or responding to an inquiry does not guarantee that a property or service is available, that a transaction will occur, or that particular results will be achieved.

2. Brokerage relationships and written agreements

Using the Site or sending an inquiry does not, by itself, establish a brokerage representation agreement. A brokerage relationship, its applicable duties and disclosures, the scope of services, and any compensation obligations are determined in accordance with Florida law and the written agreements and disclosures applicable to the transaction.

Once licensed brokerage services are lawfully available, if you choose to work with GetZelling to buy or sell real estate, we may ask you to sign a listing agreement, buyer agreement, or other appropriate documents. Those documents control the specific brokerage engagement if they differ from these general website Terms. Nothing in these Terms limits a real estate licensee’s non-waivable duties under applicable law.

3. Brokerage fees and savings examples

Any commission rates, flat fees, savings calculators, or comparisons shown on the Site are provided to explain advertised service offerings and, where indicated, to illustrate potential outcomes. Real estate broker compensation is negotiable and is not set by law. Your actual services, fees, and payment arrangements will be set out in the relevant signed agreement.

A listing-side fee is not necessarily the total cost of selling a home. Any compensation for a buyer’s broker, if agreed, is separate and negotiable. Closing costs, taxes, concessions, financing expenses, and other transaction expenses may also apply. Calculator examples use assumptions that may not reflect your transaction; they are not binding quotes, promises of savings, or guarantees of a sale price.

4. Listings and property information

Property descriptions, photographs, availability, asking prices, status, floor area, lot size, amenities, condominium or association information, taxes, flood exposure, zoning, schools, and comparable sales may be obtained from owners, public records, multiple listing services (MLSs), other brokers, or third-party providers. This information may be delayed, incomplete, incorrect, withdrawn, or changed without notice.

You should independently verify information important to your decision through appropriate professionals, official records, inspections, surveys, association documents, and other due diligence. References to a third-party brokerage or listing do not imply that GetZelling is its listing broker, that it is an active GetZelling listing, or that the third party endorses GetZelling.

5. Market intelligence and professional judgment

The Site may display estimates, comparables, charts, examples, or reports powered by MarktMind. Automated property values and analytical outputs are estimates, not appraisals or guarantees of price, marketability, financing, investment returns, or future performance. They may change as source data and models change. Do not use them as the only basis for a real estate decision.

Real estate transactions may require independent legal, tax, accounting, insurance, engineering, lending, appraisal, or other specialist advice. Any brokerage guidance provided after the required licensure is in place does not replace services that must be provided by those professionals. Your use of the separate MarktMind website, accounts, or reports is also subject to the MarktMind Terms of Use where applicable.

6. Requests, appointments, and communications

When you submit a form, request a market report, ask for a showing, or contact an advisor, you agree to provide reasonably accurate information and to use contact details you are entitled to provide. A request does not confirm an appointment or create an obligation to provide a particular service; we will confirm arrangements separately.

We may respond using the contact details you provide in relation to your request. Marketing emails and any automated marketing calls or texts, where offered, are subject to applicable consent requirements and your choices. Submitting a general inquiry does not, by itself, authorize communications for which separate consent is required. You can unsubscribe from marketing emails using the link provided in those messages.

7. Permitted use and prohibited activities

My GetZelling lets you save property references and search criteria for personal use. You are responsible for keeping your sign-in information secure. Saved homes and searches are convenience features; listing availability and display permissions may change, and a saved property may later be unavailable. Creating an account does not establish a brokerage relationship or grant access to restricted listing information.

You may browse the Site and use its publicly offered features for lawful, personal real estate research and inquiries. You agree not to:

  • Misrepresent your identity, ownership of a property, or authority to act for another person.
  • Scrape, harvest, systematically download, or commercially redistribute listings, photographs, market data, reports, or other Site content without written permission and any necessary third-party rights.
  • Use bots or automated requests in a way that circumvents technical restrictions, harms the Site, or interferes with others’ access.
  • Attempt unauthorized access, introduce malicious code, or disrupt security measures.
  • Use Site content or services for unlawful, deceptive, discriminatory, or otherwise prohibited activity.

We may restrict access where reasonably necessary to address abuse, security concerns, or violations of these Terms, subject to applicable law.

8. Intellectual property and materials you submit

The GetZelling name, logos, Site design, original text, software, graphics, and other protected content belong to GZ PropTech Inc. or their respective rights holders. Listings, MLS content, maps, photographs, and other third-party materials may be subject to additional ownership and usage restrictions. You may not copy or reuse protected materials beyond what the law or these Terms permit without the necessary permission.

You retain ownership of information and materials you submit. You grant us a limited, nonexclusive right to use those materials as reasonably needed to respond to your request, provide services you ask for, and operate the Site, consistent with our Privacy Policy. Please do not send sensitive financial, identification, or transaction documents through an unsecured general inquiry form.

9. Third-party websites and services

The Site may link to independent property portals, MLS participants, financing or service providers, or other websites. Those third parties control their own offerings, policies, and content. Links are provided for convenience and do not automatically constitute endorsements. Your dealings with third parties may be governed by their own terms.

10. Privacy and cookies

Our Privacy Policy explains how we collect and use personal information, including information submitted through forms. Cookie choices can be managed through the Cookie settings link on the Site. By using the Site, you acknowledge that the Privacy Policy applies to information processed in connection with your visit.

11. Availability, updates, and changes to these Terms

We work to keep the Site useful and available, but individual features may be changed, suspended, or unavailable from time to time. We may revise these Terms as our services or legal requirements change and will post the updated version with a new date. Material changes will apply prospectively as required by law. Changes to these website Terms do not automatically amend a separately executed brokerage agreement.

12. Disclaimers and limitations of liability

To the extent permitted by applicable law, the Site and its general informational content are provided on an “as available” basis, without guarantees of uninterrupted access or complete, error-free information. GetZelling is not responsible for losses caused solely by relying on unverified third-party listings, hypothetical calculators, or automated estimates as substitutes for appropriate due diligence or professional advice.

To the extent permitted by law, GetZelling is not liable for indirect, incidental, special, consequential, or exemplary damages arising from use of the Site. Nothing in these Terms excludes liability or duties that cannot lawfully be excluded, or limits rights and remedies under a separate brokerage agreement or applicable consumer-protection or real estate law.

13. Applicable law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where mandatory law provides otherwise. Disputes concerning these website Terms may be brought before courts with jurisdiction in Miami-Dade County, Florida, subject to applicable legal protections and any separate signed agreement governing a brokerage transaction.

14. Equal housing opportunity

GetZelling supports equal housing opportunity and does not endorse discrimination or unlawful steering in housing-related services. All brokerage activities are subject to applicable federal, state, and local fair housing requirements.
